By accessing or using Trendr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use Trendr. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law
• Your use of the Service will not violate any applicable law or regulation

3. Account Registration

To use certain features of Trendr, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Not create more than one account or share your account credentials

4. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Post false, misleading, or deceptive content
• Impersonate any person or entity
• Collect user information without consent
• Use automated systems to access the Service
• Interfere with the proper functioning of the Service
• Upload viruses or malicious code
• Circumvent security measures
• Engage in spam or unsolicited communications
• Create fake events or mislead other users about events
• Repeatedly fail to attend events you RSVP to (gaming the reliability system)

5. Events and Attendance

5.1 For Event Attendees

• RSVPs are commitments; your reliability score reflects your attendance
• You are responsible for verifying event details and safety
• Trendr does not guarantee the accuracy of user-submitted event information
• Follow all venue rules and local laws when attending events

5.2 For Event Hosts

• You are responsible for the accuracy of your event information
• You must have proper authorization to host events at listed venues
• You agree to comply with all applicable laws and regulations
• You are responsible for the safety and conduct of your events
• Trendr may remove events that violate these Terms

6. Link Up Feature

The Link Up feature allows users to connect based on shared event attendance. By using Link Up:

• You consent to your profile being shown to other users with shared event attendance
• You agree to communicate respectfully with other users
• You will not use Link Up for commercial solicitation
• You understand that matches are based on algorithmic suggestions and are not guaranteed

7. Reliability Score and Tiers

Trendr uses a reliability score system to encourage attendance:

• Your score starts at 70 and adjusts based on your RSVP attendance
• Higher scores unlock benefits like waitlist priority
• Scores are calculated automatically and may not be manually adjusted
• Trendr reserves the right to modify the scoring algorithm
• Gaming or manipulating the system may result in account suspension

8. AI Wingman Feature

The Wingman AI provides event recommendations and assistance. AI-generated content is provided "as is" and may not always be accurate. Trendr is not responsible for decisions made based on AI recommendations. The AI does not provide professional advice of any kind.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Trendr and are protected by intellectual property laws. You retain ownership of content you create but grant us a license to use, display, and distribute your content on the Service.

You may not copy, modify, distribute, or create derivative works of our content without permission.

10. Payment Terms

Some features may require payment. All fees are non-refundable unless otherwise stated. We use third-party payment processors and are not responsible for their actions. Prices may change with notice. You are responsible for any applicable taxes.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of information transmitted
• Results from use of the Service

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOST PROFITS.

13. Indemnification

You agree to indemnify and hold harmless Trendr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

16. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
